Terms and Conditions for Web Hosting Services
Interpretation
The capitalised terms in this document have specific meanings as defined below. These definitions apply whether the terms appear in singular or plural.
Definitions
For the purposes of this Agreement:
“Company,” “We,” “Us,” or “Our” refers to New Image Hosting.
“Service” refers to the web hosting and computer IT services provided.
“You,” “Your,” or “Client” means the individual or legal entity accessing or using the Service, Hosting, or Server on behalf of which such individual is accessing or using the Service, Hosting, or Server.
“Server” refers to the Company’s web servers.
“Hosting” refers to the website and email hosting provided by the Company.
“Nextcloud” refers to the cloud storage services provided by the Company.
Disclaimer
In no event shall the Company be liable for any financial, special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence, or other tort, arising out of or in connection with the use of the Service, Hosting, Servers, or Nextcloud.
The Company reserves the right to make additions, deletions, or modifications to the contents of the Servers and Hosting at any time without prior notice for the purpose of maintenance or legal requirement. The Company makes extensive efforts with virus scanning, firewall, and security protection. However, the Company does not warrant that the Server is free of viruses or other harmful components due to the ever-changing world of IT security and Server/Hosting exploitation.
Our Servers are hosted on the Debian Linux OS with CSF firewall, SpamAssassin email filtering, and ClamAV Virus Scanning. The user interface is provided and maintained by the Virtualmin GUI.
Content and Links Disclaimer
The Service, Hosting, and Server may contain content or links to external websites not provided, maintained, or affiliated with the Company. The Company does not guarantee the accuracy, security, or legitimacy of any information on these Hosting or external websites.
No Responsibility Disclaimer
In no event shall the Company or its suppliers be liable for any financial, special, incidental, indirect, or consequential damages arising out of or in connection with your access, use, or inability to access or use the Service, Hosting, Server, or Nextcloud.
Consent
By using our Service, Server, Hosting, or Nextcloud, you agree to these terms and conditions.
Your Undertakings & Obligations
You may not use the Servers or any other Hosting and Services for unlawful or inappropriate purposes. This includes, but is not limited to:
a) Distribution of viruses, spyware, malware, or any other form of code designed to cause harm or nuisance to hardware or software or to obtain data without consent;
b) Distribution of pirated material including, but not limited to software, movies, music, and written works; and Distribution of obscene or illegal material including that which is pornographic, abusive, threatening, malicious, harassing, fraudulent, defamatory, or that which encourages criminal activities;
c) Distribution of large volumes of unsolicited email (spam) to recipients. All complaints made to the Company of such activity will be investigated and may result in immediate suspension or cancellation of service at the Company’s sole discretion;
d) You may not use Your website to link to any other sites or systems hosting any material described above;
e) Use of Your Website in any manner which is a violation or infringement of the rights of any individual, firm, or company within the United Kingdom and elsewhere.
You will monitor and supervise any and all third-party activity on Your website (including communications systems such as forums). Any third-party activity that may fall within the criteria above must be stopped or removed, as appropriate.
You must ensure that any and all activity conducted through Your Service in relation to the collection of personal information complies with the provisions of the Data Protection Act 2018 and UK GDPR.
You are responsible and accountable for all activity relating to Your Service and the conduct that is carried out by third parties on Your behalf.
To protect the Servers and the Company’s other clients, You will ensure appropriate maintenance is carried out on Your Service on a regular basis. As a minimum, this should include the regular updating of open-source frameworks and plugins, implementation of security patches, and security scans and monitoring.
You recognise that available bandwidth is limited, and that the Company may limit access to any large amounts of material made available through the Servers to maintain a reasonable level of service to the Company’s other clients.
You agree not to use the Servers for bandwidth-intensive activities, including the distribution or serving of video files, audio files, and downloadable digital assets. Your Service that incorporates these types of activities should utilise a suitable third-party storage provider to deliver these assets using a method that ensures the Company’s network does not incur the bandwidth associated with these activities.
Copyright
New Image Hosting makes efforts to identify copyright infringements on our servers. Hosting images or intellectual property you do not have rights to use is not allowed.
If you believe an image or intellectual property is being infringed, report it to us for removal. Please email copyright-issue@NewImageHosting.co.uk, providing corroborating information, and we will investigate.
Service Abuse
We reserve the right to terminate any Service, Hosting, or Server in the event of abuse. Abuse includes illegal activity, copyright infringement, deliberate spamming, and other harassing online activity. We will attempt to resolve issues before termination to avoid disruption to your Service, Server, Hosting, or Nextcloud. No refunds will be issued for the remaining duration of your plan.
Communication Protocol
Changes to our terms will be posted on our website and communicated via email. Please note that email delivery cannot be guaranteed. If this protocol does not meet your requirements, you may terminate your service with the Company.
